Terms & Conditions
By enrolling your child at Largs Youth Theatre, you accept these terms and conditions ("Terms") and these terms govern your ongoing relationship with Largs Youth Theatre Ltd ("Agreement").
The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled student ("Student") by a Parent and Largs Youth Theatre Ltd ("LYT", "we", "our", "us") and is valid at all times whilst the Student is enrolled on any LYT activity and until such time as written notice is given in accordance with these Terms.
1. IMPORTANT INFORMATION & DEFINITIONS
1.1 These Terms apply to all our Classes, Special Workshops, Camps, and any additional products and/or services offered by Us to any Student (collectively "LYT Activities")
1.2 For participation of a Student in a LYT Activity all Parents are required to consent to these Terms when enrolling the Student onto a LYT Activity. We may update these Terms from time to time and you will be notified of any changes.
1.3 Important definitions used in these Terms:
- A "Class" refers to a course of weekly classes offering tuition in drama and theatre arts which will be delivered during our Term (whether in person or remotely via online platforms). Classes will take place on set date, at set times, per week for set hours as fully described at the time of booking.
- "Special Workshops/Camps" refers to (a) standalone events, or (b) multi day events camps, (either being in person or remotely via online platforms) offered as a service at our discretion during a Term or during breaks in Term throughout the year.
- "Term" refers to one normal nine month term during which Classes are offered, from 1 September to mid June in any given year.
- "Term Dates" refers to the dates for the relevant Term as publicised at time of booking
2A. ENROLLING A STUDENT INTO A CLASS & CLASS CONDUCT/RULES
2A.1 To enroll for a Class for the Term, a Parent must agree to these Terms and make a booking for the relevant Class online via our booking system.
2A.2 Each Student's place is allocated on a 'first come, first served' basis and we reserve the right to limit class numbers at any time and for any reason. If any Class has reached capacity, a Parent can select to join a waitlist via the online booking system. We cannot guarantee that a waitlisted child will succeed in obtaining a space at the start of, or during the Term.
2A.3 All Parents, Students and LYT personnel are expected to act with kindness, respect and honesty at all times. We foster an inclusive environment and a safe space for all Students and we have a zero tolerance approach to offensive behaviour, physical or verbal abuse or use of bad language.
2A.4 We may, at our own discretion, refuse a Student entry to a LYT Activity or, individual session of such an activity if it is felt that the Student's behaviour is unacceptable and this Agreement will be terminated by LYT at its discretion.
2A.5 For Wee Stars Classes, Parents, or a designated individual whose name shall be provided to LYT in advance of a Class, will require to remain in the Class room at all times, or be seated within the seating area of the building in which classes take place.
2A.6 All other Students must be dropped off at the door of any LYT Activity by a Parent or designated person, and collected on time after a session from within the building for safeguarding purposes. LYT is unable to supervise Students after a session end time and consistent late collection will result in additional charges.
2B. HEALTH AND SAFETY, MEDICAL AND UNIFORM
2B.1 Students participate at their own risk and are obliged to inform LYT of any existing injuries or medical condition. All registration forms completed at point of booking must have any known medical conditions stated and any changes to such information must be notified to LYT immediately in writing. Parents explicitly agree to provide any and all relevant medical information pertaining to the Student that is necessary for LYT to be aware of in order to deliver any LYT Activities safely to the Student, and for the safety of others which may include access needs such as use of visual aids, enlarged print materials or physical access (our venue has stair free access).
2B.2 It is the Parent responsibility to ensure that any Student with any medical condition consults with a medical practitioner regarding the safety of participation in LYT Activities prior to enrolling. Any medication brought to any LYT Activity must be clearly labelled and the Student should, unless LYT has agreed with the Parent in writing otherwise, be able to administer it themselves.
2B.3 Students must wear suitable footwear and clothing at all times, including LYT uniform which can be purchased separately. The only mandatory element of the uniform is a t shirt, all other items are optional purchases for Parents. Students should bring a water bottle to any LYT Activity (and if any food is requested to be brought, this will be outlined in any booking page when an activity is publicised).
2B.4 If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided on any registration form (and contact may be made by telephone or text message). By providing contact telephone numbers you, the Parent, acknowledge that voicemails may be left on this line pertaining to your Student. You are solely responsible for ensuring that all contact details held by us are accurate and up to date.
2B.5 Any LYT Activities conducted online through platforms such as Zoom, are recorded and stored for a period of four weeks for safeguarding purposes.
3. MAKING MONTHLY RECURRING PAYMENTS FOR CLASSES
3.1 For a Student enrolled in our Classes, payments are made by recurring monthly card payment, via our third party payment processors and booking system operators. Please refer to their subscription terms and conditions when making your booking. We instruct the system to deduct payments over the course of ten (10) months, from 1st September to 1st June, inclusive. If a Student joins during any month, a pro rata payment may fall due to ensure payments are up to date for all Classes attended.
3.2 You have a fourteen (14) calendar day cancellation period ("Initial Cancellation Period") to change your mind and cancel the Student's place on any Class, less any payment falling due on a pro rata basis for any Class which the Student has participated in, within that Initial Cancellation Period.
3.3 We may, at our discretion, offer the third child of the same family attending any Class during the same Term as other two siblings, a sibling discount equal to the third sibling attending free of charge. This discretionary sibling discount will only apply if we are notified of the sibling relationship prior to the Parent making the booking online.
3.4 All Class fees charged by LYT for Classes (and indeed other LYT Activities), are reviewed annually and may be increased each year. We make no guarantee that Classes will be available on the same terms or at same prices and schedules as the Term you are booking for.
4. FREE SESSIONS
4.1 We may from time to time, at our discretion, offer free sessions, being standalone sessions on dates and times as we determine, for the purposes of (a) offering bonus Classes to enrolled Students, or (b) allowing potential new Students and their Parents to trial LYT Activities. Attendees, being enrolled Students or potential new Students, must be registered in advance to attend any such sessions, no walks in are accepted.
5. SPECIAL WORKSHOPS & CAMPS
5.1 We may, from time to time, at our discretion, offer Special Workshops and/or Camps during the Term, or during any break in Term. Full information, dates and times of such activities will be published in advance and will require to be pre booked.
5.2 For a Student enrolling on any Special Workshops/Camp, if there is a payment to be made, the full payment shall be made at the time of booking. Unless otherwise stated, no free trials can be taken during such events, and no sibling discounts apply.
5.3 You have a fourteen (14) calendar day cancellation period ("Event Cancellation Period") to change your mind and cancel the Student's place on any Special Workshops/Camp, less any payment falling due on a pro rata basis for any Special Workshops/Camp (for example on multi day events) which the Student has participated in, within that Event Cancellation Period.
5.4 If any Special Workshops/Camp is advertised as multi-day attendance, there is no reduction in fees payable if your Student cannot attend a given day.
6. DISCLOSURE OF PERSONAL INFORMATION
6.1 The personal data (as it is defined in the Data Protection Act 2018) of a Student and/or Parent will be collected, stored and processed by LYT for the purposes of providing LYT Activities to you or the Student, and for the purposes of potentially entering into a contract with a non-Student.
6.2 Parents will be asked to grant permission/deny permission in respect of photography, videography and other such publicity consents at the time of booking. Should that consent change after time of booking you must inform us by writing to us (including by email).
7. LIMIT OF LIABILITY
7.1 Any personal items brought into any LYT Activity are brought in at Student’s own risk. LYT accepts no liability for lost or damaged personal items.
7.2 You acknowledge that the maximum aggregate liability of LYT to a Student or Parent under this Agreement shall not exceed the fees paid by the Parent/Student in respect of the LYT Activity to which a claim relates. Where there is no fee paid for any LYT Activity that is booked free of charge, the maximum liability of LYT is £50 GBP.
7.3 To the maximum extent permitted by law, the liability of LYT and that of its officers, staff, and contractors is restricted to LYT Activity time only and only to instances of gross negligence on the part of any officer, staff member or contractor directly engaged by LYT to deliver the LYT Activity. Nothing herein is intended to limit any legal liability which arises and cannot be limited at law, including fraud, negligence and other such instances.
8. CANCELLATION OF LYT ACTIVITIES AND AMENDMENTS
8.1 No refunds will be payable in respect of any LYT Activity that a Student does not attend due to illness, holidays, weather (where the LYT Activity is still planned to take place) or any other reason.
8.2 If a Class session is cancelled for any reason by LYT at any time during the Term, then LYT has the choice of (a) organising a replacement class which will be added at a suitable time during the Term, or (b) if no alternative session can be arrange, we will provide a partial refund on pro rata basis for any missed Class cancelled by LYT. In event of a Class cancellation, as much notice will be given as possible including publication on our social media pages, by email and text message to contact information for a Parent provided to us. If a Special Workshop/Camp is cancelled, partial refunds, or whole refunds if the activity has not commenced, will be provided.
8.3 We reserve the right to make changes to the LYT Activities advertised, any timetable, the teaching tutors, the advertised programme or the session delivery method (such as a need to change to a remote online session instead of in person) in the event of illness or other circumstances beyond our control.
8.4 Where LYT deems it absolutely necessary to change the time and/or venue of a LYT Activity session, we will do our best to keep to originally advertised LYT Activity times, programme delivery mechanisms and/or locations but unfortunately this cannot always be guaranteed.
9. GOVERNING LAW AND JURISDICTION
9.1 These Terms constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
9.2 In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.
9.3 The Agreement shall be governed by, and construed in accordance with, the laws of Scotland and any dispute, proceedings or claim shall fall within the jurisdiction of the Scottish courts.
